Official Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. ELIGIBILITY: INTERNET ACCESS IS REQUIRED.
If the value of hunt is GREATER than $5,000: Open only to legal residents of the 50 United States (excluding FL and NY), the District of Columbia, or Canada (excluding Quebec) who are at least 18 years of age (or the age of majority in their state or province of residence, if greater than 18) or older at time of entry. Void in Florida and New York and in Quebec, Canada and where prohibited.
If the value of hunt $5,000 or LESS: Open only to legal residents of the 50 United States, the District of Columbia, or Canada (excluding Quebec) who are at least 18 years of age (or the age of majority in their state or province of residence, if greater than 18) or older at time of entry. Void in Quebec, Canada and where prohibited.
Persons in the following categories are not eligible to participate or win a prize: (a) employees and directors of Sponsor, and its parent, affiliates, subsidiaries, advertising and promotion agencies; (collectively the “Sweepstakes Entities”); (b) individuals or entities responsible for the development, printing, distribution and implementation of this promotion; and (c) persons who are employees of or members of the immediate family (parents, siblings, children & spouse) or household of any person in any of the preceding categories. By participating you agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects.
2. PROMOTION PERIOD: Sweepstakes starts on or about 12:00:00 a.m. Eastern Time (ET) on March 11, 2010 and ends at 9:00 p.m. ET on March 11, 2010 (“Promotion Period”). Sponsor’s clock is the official time keeping device for the promotion. Each entrant agrees to comply with Sponsor’s Privacy Policy and Conditions of Use posted on the Site.
3. HOW TO ENTER AND PARTICIPATE: MyDreamHunts.com Members: To register as a Member, prior to 6:00 p.m. ET or during the Promotion Period, access the Site and follow all on-line registration directions. You may register as a Member only once, using only one name and email address. Multiple registrations per person/email address are prohibited and will cause that entrant to be disqualified. In case of dispute, entries will be declared made by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Each Member in good standing during the Promotion Period will receive one automatic entry into the Sweepstakes.
4. SELECTION OF WINNER: The Grand Prize will be selected at random by Sponsor’s computer from among all eligible entries received during the Promotion Period. Winner is subject to verification and compliance with these Official Rules. Odds of winning depend on the number of eligible entries received. If a Canadian resident is selected, prior to being confirmed as a winner of a prize, the potential winner must have correctly answered a mathematical skill-testing question. This question will be administered in advance at the time of Member registration.
5. PRIZE: 3 Day Colorado Turkey Hunt, Approximate Retail Value (ARV): $2,800 USD/$2,873 CAD. Actual value of prize may vary depending on various options provided by the Participating Outfitter and agreed to by the winner. Important Notice: Transportation to or from the hunt location is not included. All dates for the hunt depend on the availability of the Outfitter providing the prizes. Blackout dates and other restrictions may apply. Winner must make all arrangements directly with the specified prize provider Outfitter. Winner is responsible for obtaining any required passport, visa or other travel documents, and for traveling to and from the arrival/departure points. All items or expenses not listed as included in the prize are excluded. No prize substitutions, unless specified, except that Sponsor reserves the right to substitute a prize comparable in value in the event of prize unavailability. All federal, state, provincial and local taxes on a prize are the sole responsibility and liability of the prize winner. Prize may not be transferred, substituted, assigned or redeemed for cash, except at the Sponsor’s sole discretion.
6. HOW TO CLAIM PRIZES: Potential winner will be notified within approximately twenty-four hours or less after selection, by email or other method determined by Sponsor, with instructions on how to contact the outfitter providing the hunt in order to claim the prize. The outfitter providing the hunt to the winner will also be sent an email with the potential winner’s contact information. It is solely the responsibility of the winner to contact the outfitter and claim the prize within the time periods stated in the notification email, if any. If a potential winning entrant cannot be contacted; is ineligible; fails to claim the prize; is unwilling or unable to accept prize; if the prize notification is returned undeliverable; or if the potential winner otherwise fails to fully comply with these official rules, he/she will forfeit that prize and the prize may be awarded to an alternate potential winner. If a verified winner fails to redeem the prize in accordance with instructions by the date provided, the prize will be forfeited and will not be reawarded.
7. VERIFICATION: Limit one prize per entrant. All prize claims are subject to verification by Sponsor and/or the outfitter providing the prize. You are not a winner until your prize claim has been timely received and verified/validated by the outfitter providing the prize, and you have complied with these Official Rules. Only the prizes stated in these Official Rules are available to be won in the Sweepstakes and will be awarded. All materials submitted become the property of Sponsor and will not be returned.
8. GENERAL CONDITIONS: By participating, participants agree (a) to be bound by these Official Rules; (b) that the decisions of Sponsor are final on all matters relating to this Sweepstakes; (c) to Sponsor’s use of participant’s name, address and other personally identifiable information in accordance with Sponsor’s privacy policy; and (d) that the applicable outfitter is solely responsible for providing the prize to the winner. Sponsor is not the owner or provider of the prize; rather, Sponsor serves as the facilitator for the selection of the winner and awarding of the prize directly to the winner by the outfitter. Where permitted by law, winner grants to Sponsor, (which grant will be confirmed in writing on request of Sponsor) its parents, subsidiaries, affiliates and those acting pursuant to its authority, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's name, address (city & state), portrait, picture, voice, likeness and biographical information for advertising and promotional purposes without additional consideration. By accepting prize, the winner agrees to indemnify, release and hold harmless the Sweepstakes Entities, their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any claims, injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in any Sweepstakes or prize use related activity, or participation in this Sweepstakes.
PARTICIPANTS AGREE THAT THE SWEEPSTAKES ENTITIES HAVE NOT MADE NOR ARE THEY IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE PROMOTION. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE SWEEPSTAKES ENTITIES DO NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE OUTFITTER PROVIDING THE GRAND PRIZE HUNT AND THE SWEEPSTAKES ENTITIES SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. THE PROVISIONS REGARDING IMPLIED WARRANTIES ARE VOID IN SOME STATES WHERE IMPLIED WARRANTIES ARE PRESCRIBED BY LAW. Sponsor is not responsible for: (i) electronic transmissions that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation of transmission, communication failures, destruction or unauthorized access to, or alteration of, entries, or (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes. If for any reason this Sweepstakes and/or the Site, in whole or in part, is not executed as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, and select the winner based on entries prior to the action or as otherwise may be deemed fair and equitable by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with the entry process or who enters using any automatic or programmed duplication method. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE CORRUPT THE INTERNET PORTION OF THIS SWEEPSTAKES, OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9. DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF COLORADO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the 4th Judicial District in Teller County, Colorado having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participants’ actual out-of-pocket expenses (i.e. costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
10. WINNERS LIST: Winners lists for all winners of all daily hunt giveaways will posted on the Site for a given time period. Winner’s name for this Sweepstakes will be posted on the Site approximately two (2) days after the end of the Promotion Period.
